DMCA Copyright Policy

Pineapple Rum Punch respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below regarding copyright infringement on our website. This policy outlines the procedures for copyright holders to request the removal of allegedly infringing material and for users to submit counter-notifications if their material is mistakenly removed.

We will respond expeditiously to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

Filing a DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on Pineapple Rum Punch infringes upon your copyrights, you may submit a written notification pursuant to the DMCA by providing our designated Copyright Agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed: This should include a description of the work, and where possible, a copy or the location (e.g., URL) of an authorized version of the work.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Filing a DMCA Counter-Notification

If your content has been removed or access disabled as a result of a DMCA Takedown Notice, and you believe that the material was removed or disabled by mistake or misidentification, you have the right to submit a counter-notification. Your counter-notification must be a written communication provided to our designated Copyright Agent and include substantially the following:

  • Identification of the material that has been removed: Identify the specific URL(s) of the material that Pineapple Rum Punch has removed or to which access has been disabled.
  • A statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Sufficient contact information for us to reach you.
  • A statement that you consent to the jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Pineapple Rum Punch may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
